Here are a three of the most asked questions regarding international real estate purchases.
As many of you know, we previously owned property in Costa Rica. Since we decided to sell that property, we have been talking about (for several years) making another vacation condo purchase in another beautiful location. We previously looked at property in the Punta Cana area of the Dominican Republic, but thought the market was over saturated for vacation rentals. We went to the Los Cabos area for the first time in 2017. We really liked the area which has three parts - Los Cabos itself which is the typical thought people have; San Jose del Cabo which is a much more typical Mexican town; and then there is the area in between called the Corridor. Really, there is something for everyone in the greater Cabo area. Of course, the Cabo area is an appreciating real estate market that makes for a good investment.
Finally, on our third trip to Cabo and four years later, we pulled the trigger and purchased two assets - Wen Living located in San Jose del Cabo and Tramonti Paradiso located in the Corridor but much closer to Los Cabos. See below for more detailed information on the exact properties.
Yes. There is crime in Mexico. However, the Los Cabos area is generally very safe and has a sizable expat population. To put it in perspective, we felt safer walking through either Los Cabos or San Jose del Cabo then we do in downtown St. Louis or Chicago or Dallas or insert any large metro area in the U.S.
The short answer is YES for most countries in Latin America or the Caribbean. The longer answer is full, titled ownership is generally set up through an entity that is wholly owned by the individual(s). For Mexico, this entity is actually a trust. In Costa Rica, the entity was a business (much like an LLC in the U.S.). In our case, an entity we own in the U.S. will be the beneficiary of the Mexican property trust. Yes, that is done for tax and estate planning purposes.
You need to complete a reasonable level of due diligence regardless of where the property is located - around the corner from where you live now or in a foreign country. Finding a quality real estate agent in a foreign country is also critical to navigating the process and especially the pitfalls of purchasing in that particular market. We had been looking at properties in Cabo for over four years so we felt very comfortable with the area and seen numerous finished products from the area builders and developers. Just like the U.S., there is a wide variation in quality, finishes, and overall price. We ultimately purchased property from the developers that had a proven record of success based on other completed projects in the area.
We were also impressed with the level of detail and attention to the actual contracts. We made sure all of the negotiated items were present in writing. In fact, the developers readily agreed to some items without debate or issue. It is true the legal jurisdiction should there be litigation is in Los Cabos, Mexico, which could be a potential headache. Another reason we purchased with proven and well respected developers.
